By accessing or using any application or service provided by kygeek studio, LLC ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our products.

2. Description of Services

kygeek studio develops and distributes mobile applications through the Apple App Store. Our apps may include both free and paid features accessible through in-app subscriptions managed by Apple.

3. Subscriptions and Payments

  • Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
  • You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
  • We do not process payments directly. All billing inquiries should be directed to Apple Support.
  • Free-tier usage limits reset daily at midnight (device local time). Usage is consumed when playback starts; early stops do not refund consumed time.

4. Intellectual Property

All content, code, design, and audio generated by our applications are the intellectual property of kygeek studio, LLC. You may not reproduce, distribute, or create derivative works from our software without prior written consent.

5. Limitation of Liability

To the maximum extent permitted by applicable law, kygeek studio, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our applications.
  • Any unauthorized access to or alteration of your data.
  • Any interruption or cessation of service.
  • Any bugs, viruses, or similar issues transmitted through our apps.

6. Disclaimer of Warranties

Our applications are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Health Disclaimer

Our apps may include audio features such as ambient soundscapes and low-frequency audio patterns. These features are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition. If you have a medical condition, consult a healthcare professional before use.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law provisions.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
